ARSEN’S GYM TERMS OF SERVICE

These Terms of Service apply to the websites, member portals, mobile services, text-messaging programs, and other online services operated by Arsen’s Training LLC, doing business as Arsen’s Gym, and its affiliated Arsen’s Gym operating entities.
In these Terms, “Arsen’s Gym,” “we,” “us,” and “our” refer to these entities.
By accessing or using our website, member portal, mobile services, or communications, you agree to these Terms.
1. WEBSITE AND ONLINE SERVICES
Our website and online services may allow you to review membership information, enroll in a membership, manage billing details, make payments, receive account notifications, contact customer support, and use other membership-related services.
You agree to provide accurate, complete, and current information. You are responsible for keeping your contact information, mobile telephone number, email address, mailing address, and billing information updated.
2. MEMBERSHIP TERMS
Membership purchases, dues, fees, renewals, cancellations, freezes, access privileges, facility rules, and related matters are governed by the membership agreement accepted when you join Arsen’s Gym.
If these Terms conflict with a signed membership agreement concerning membership-specific matters, the membership agreement will control.
3. BILLING AND PAYMENTS
You authorize Arsen’s Gym and its payment-processing providers to process payments according to your membership agreement and the payment methods you provide.
Payment-card and bank-account information may be securely collected, tokenized, and processed by third-party membership-management and payment-processing providers. Arsen’s Gym may receive payment status, transaction, decline, return, and account-management information from those providers.
You are responsible for maintaining valid payment information and paying amounts owed under your membership agreement.
4. ARSEN’S GYM ACCOUNT AND BILLING NOTIFICATIONS SMS PROGRAM

Arsen’s Gym Account and Billing Notifications
Program Description:
Members may voluntarily enroll to receive recurring account and billing-related text messages from Arsen’s Gym.
Messages may include:
• Payment-processing notifications
• Failed-payment alerts
• Billing-detail update reminders
• Outstanding-balance notifications
• Payment-status updates
• Requests to update an expired or invalid payment method
• Billing-related customer-support replies
This SMS program is not used for promotional offers, advertising, marketing campaigns, booking notifications, or unrelated general announcements.
Enrollment is optional and is not a condition of purchasing or maintaining an Arsen’s Gym membership.
Message Frequency:
Message frequency varies depending on account activity, billing status, and customer-support interactions.
Message and Data Rates:
Message and data rates may apply according to your wireless-service plan.
Opting Out:
You may unsubscribe from this SMS program at any time by replying STOP to any Arsen’s Gym text message.
After opting out, you may receive a confirmation message. You will no longer receive messages from this SMS program unless you affirmatively opt in again.

Carrier Disclaimer:
Wireless carriers are not liable for delayed or undelivered messages.
Mobile Number Responsibility:
You represent that you are the authorized user of the mobile number provided.
If your mobile number changes, is disconnected, or is reassigned to another person, you agree to update your Arsen’s Gym account promptly.
Consent Records:
We may maintain records showing when, where, and how you consented to receive text messages, the consent language presented to you, and when you withdrew or renewed that consent.
Privacy:
Participation in the SMS program is subject to the Arsen’s Gym Privacy Policy.
SMS opt-in data, mobile numbers, and text-messaging consent will not be sold, rented, transferred, or shared with third parties for their own marketing or promotional purposes.
5. CUSTOMER COMMUNICATIONS
Arsen’s Gym may contact you through email, telephone, mail, application notifications, or other methods permitted by your membership agreement, communication preferences, and applicable law.
Opting out of SMS messages does not cancel your membership or eliminate your responsibility to keep your billing and contact information current.
6. ACCEPTABLE USE
You may not:
• Submit false, fraudulent, or misleading information
• Attempt unauthorized access to any account or system
• Interfere with the operation or security of our services
• Use another person’s account or identifying information without authorization
• Use our website or services for unlawful purposes
• Copy, scrape, reproduce, or misuse our website content or systems
7. THIRD-PARTY SERVICES
Our services may use or integrate with third-party providers, including membership-management systems, payment processors, banks, communications providers, website hosts, analytics providers, and customer-support platforms.
Those providers may have their own terms and privacy practices. Arsen’s Gym is not responsible for third-party services outside our reasonable control.
8. INTELLECTUAL PROPERTY
The Arsen’s Gym name, logos, trademarks, website content, graphics, photographs, designs, and related materials are owned by or licensed to Arsen’s Gym.
They may not be copied, modified, distributed, or commercially used without written permission.
9. SERVICE AVAILABILITY
We may modify, suspend, restrict, or discontinue any website, member-portal, mobile, or communication feature at any time.
We do not guarantee uninterrupted, error-free, or completely secure access to online services.
10. DISCLAIMER OF WARRANTIES
Our websites and online services are provided on an “as is” and “as available” basis.
To the extent permitted by law, Arsen’s Gym disclaims warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. LIMITATION OF LIABILITY
To the extent permitted by law, Arsen’s Gym will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of, or inability to use, our website, member portal, mobile services, or communication services.
Nothing in these Terms limits rights or remedies that cannot legally be limited.
12. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Arsen’s Gym and its owners, affiliates, employees, and service providers from claims resulting from your unlawful misuse of our website or online services or your violation of these Terms.
13. CHANGES TO THESE TERMS
We may update these Terms periodically.
The updated version will be posted on this page with a revised effective date. Your continued use of our website or online services after an update constitutes acceptance of the revised Terms.
14. GOVERNING LAW
These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles, except where another applicable law must govern.
15. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
